1. Introduction

Welcome to Palpable, a product operated by Epode AB, a company registered in Sweden (org. nr. 559486-8780) ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our services, including our website, mobile applications, and IoT hardware products.

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Definitions

• "Service" refers to the Palpable platform, including website, mobile apps, and hardware products
• "User" refers to any individual who accesses or uses the Service
• "Device" refers to Palpable IoT hardware products
• "Content" refers to any data, text, or other materials uploaded or created through the Service

3. Use of Service

Palpable provides a platform for creating and managing IoT projects with AI capabilities. You agree to use the service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the service in any way that violates applicable laws or regulations
• Attempt to interfere with the proper functioning of the service
• Reverse engineer or attempt to extract source code from our software
• Use the service to transmit harmful or malicious code
• Impersonate or attempt to impersonate Epode AB or any other user
• Use the service to harass, abuse, or harm others
• Circumvent any security features or access controls

4. Account Registration

To use certain features of the service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Not share your account with others

5. Hardware Products

When you purchase hardware from us:

• You receive ownership of the physical hardware
• Software on the device is licensed, not sold
• You must use the hardware in accordance with applicable laws
• Warranty terms are provided separately with your purchase

Hardware returns and refunds are subject to our refund policy and applicable consumer protection laws, including the EU Consumer Rights Directive which provides a 14-day withdrawal period for online purchases.

6. Subscriptions and Payments

Some features require a paid subscription. By subscribing:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions auto-renew unless cancelled before the renewal date
• Prices may change with 30 days notice
• Refunds are provided in accordance with applicable laws

Payments are processed by Mollie B.V. and subject to their terms of service.

7. Intellectual Property

The service and its original content, features, and functionality are owned by Epode AB and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create using our service, but grant Epode AB a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely to provide the service.

8. AI and Voice Features

Our service includes AI and voice processing features. By using these features:

• You consent to voice data being processed by third-party AI providers
• You understand AI responses may not always be accurate
• You agree not to use AI features for illegal or harmful purposes
• You acknowledge AI-generated content should be reviewed before use

9. Limitation of Liability

To the maximum extent permitted by law, Epode AB shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Service interruptions or data loss
• Actions of third-party service providers

This limitation does not affect your statutory rights under applicable consumer protection laws, including rights under EU consumer law.

10. Warranties

The service is provided "as is" without warranties of any kind, either express or implied. However, this does not affect:

• Statutory warranties required by applicable law
• Your rights under EU consumer protection laws
• Hardware warranty terms provided with your purchase

11. Termination

We may terminate or suspend your access to the service:

• For violation of these Terms
• For illegal or harmful activity
• If required by law
• For non-payment of fees

Upon termination, your right to use the service will cease. You may request export of your data within 30 days of termination.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Sweden. Any disputes shall be resolved:

• First through good-faith negotiation
• Then through mediation if negotiation fails
• Finally through the courts of Sweden

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

13. Changes to Terms

Epode AB reserves the right to modify these Terms at any time. We will provide at least 30 days notice of material changes by posting the new Terms on this page, updating the "Last updated" date, and notifying you via email. Your continued use of the service after changes take effect constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
