1. Introduction

Welcome to Palpable, a product operated by Epode AB, a company registered in Sweden (org. nr. 559486-8780) ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our services, including our website, mobile applications, and IoT hardware products.

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Definitions

"Service" refers to the Palpable platform, including website, mobile apps, AI assistant (PAL), and hardware products
"User" refers to any individual who accesses or uses the Service
"Device" refers to Raspberry Pi hardware running Palpable software
"PAL" refers to the AI assistant that helps you build and manage hardware projects
"Script" refers to automations you create that run locally on your Device
"Generated Software" refers to any code, configuration, or automation produced for you by PAL or any other automated feature of the Service, whether or not you subsequently edit it
"Add-on" refers to optional paid capabilities (e.g., Voice on Pi) that can be added to any subscription tier
"Content" refers to any data, scripts, configurations, or other materials uploaded or created through the Service

3. Use of Service

Palpable provides a platform for creating and managing IoT projects with AI capabilities. You agree to use the service only for lawful purposes and in accordance with these Terms.

You agree not to:

Use the service in any way that violates applicable laws or regulations
Attempt to interfere with the proper functioning of the service
Reverse engineer or attempt to extract source code from our software
Use the service to transmit harmful or malicious code
Impersonate or attempt to impersonate Epode AB or any other user
Use the service to harass, abuse, or harm others
Circumvent any security features or access controls
Use automated tools to make excessive API calls or abuse system resources

4. Account Registration

To use certain features of the service, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access
Not share your account with others

5. Hardware Products

When you purchase hardware from us:

You receive ownership of the physical hardware
Software on the device is licensed, not sold. Open-source components in the device software and our apps are governed by their own licences, listed at palpable.technology/open-source.
You must use the hardware in accordance with applicable laws
Warranty terms are provided separately with your purchase

Hardware returns and refunds are subject to our Refund Policy and applicable consumer protection laws, including the EU Consumer Rights Directive which provides a 14-day withdrawal period for online purchases.

6. Subscriptions, Tiers, and Payments

6.1 Subscription tiers

Palpable offers three subscription tiers: Personal, Entrepreneur, and Enterprise. Each tier provides access to PAL at full capability — the same AI intelligence is available on every tier. Tiers differ in the number of connected devices, PAL availability (on-demand or always-on), and sensor data retention period. 6.2 Free trial

New accounts enter a pre-activation state until hardware arrives. Your trial begins when your device first connects to the cloud, or when you manually activate it in the app. The trial lasts 14 days and provides full access to all features, including all add-ons. A valid payment method is required at signup but you will not be charged during the trial. At the end of the trial, you will be charged for your chosen tier unless you cancel beforehand.

6.3 Billing

Subscriptions are billed monthly or annually. Annual plans include a discount equivalent to two free months
You authorize us to charge your payment method on a recurring basis
Subscriptions auto-renew unless cancelled before the renewal date
Prices may change with 30 days notice
Refunds are provided in accordance with applicable laws

6.4 Add-ons

Optional paid capabilities (such as Voice on Pi) can be added to any subscription tier. Add-ons are billed monthly regardless of your plan's billing cycle. You may add or remove add-ons at any time; charges are prorated for the current billing period.

6.5 Pausing and cancellation

You may pause your subscription at any time. When paused:

Billing stops immediately
Your devices continue running — all scripts, automations, and local functionality remain active
PAL access stops — you cannot create or modify projects, scripts, or configurations
Your data, conversation history, and device configurations are preserved indefinitely
You may resume at any time with one click — your saved payment method is used, no re-entry required

Our order process is conducted by Paddle.com Market Limited, our authorised reseller and merchant of record. Paddle is the seller of record for all orders: your purchase contract for the product is with Paddle, Paddle handles payment, billing and applicable VAT or sales tax, and Paddle's terms of sale and privacy notice apply to that transaction. Refund and billing enquiries may be raised with Paddle or with us.

7. Intellectual Property

The service and its original content, features, and functionality are owned by Epode AB and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create using our service, including scripts and device configurations. You grant Epode AB a non-exclusive, worldwide, royalty-free license to use, store, and process such content solely to provide the service.

8. AI and Voice Features

Our service includes AI and voice processing features. By using these features:

You consent to voice data being processed by third-party providers (Gladia for speech-to-text)
You understand AI responses may not always be accurate
You agree not to use AI features for illegal or harmful purposes
You acknowledge that scripts generated by PAL should be reviewed before deployment to safety-critical applications
Voice data is processed in real-time and not stored — only transcripts are retained as part of your conversation history

9. Device Behavior After Cancellation

Your Raspberry Pi hardware is yours. After cancellation or pause:

All scripts and automations continue running locally on your device
Sensor readings continue to be collected locally
Cloud synchronization of sensor data stops
PAL is not available — no new scripts, modifications, or AI interactions
You may continue to use the hardware independently of the Palpable service

10. Limitation of Liability

To the maximum extent permitted by law, Epode AB shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or business opportunities
Service interruptions or data loss
Actions of third-party service providers
Damage caused by Scripts, automations, or Generated Software running on your devices
Lost revenue, lost profits, or losses resulting from business interruption

This applies regardless of the form of action or legal theory under which liability is asserted, and even if Epode AB has been advised of the possibility or likelihood of such damages.

This limitation does not affect your statutory rights under applicable consumer protection laws, including rights under EU consumer law.

11. Warranties

The Service, the Palpable software, and any Generated Software are provided to you "as is". To the maximum extent permitted by law, Epode AB makes no express or implied warranties whatsoever with respect to their functionality, operability, or use, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Generated Software is produced automatically and is not reviewed by a human before it reaches your Device. You are responsible for reviewing and testing it before relying on it, and for any equipment or property it controls.

However, this does not affect:

Statutory warranties required by applicable law
Your rights under EU consumer protection laws
Hardware warranty terms provided with your purchase

12. Termination

We may terminate or suspend your access to the service:

For violation of these Terms
For illegal or harmful activity
If required by law
For non-payment of fees

Upon termination, your right to use the service will cease. Your devices will continue to function locally with existing scripts. You may request export of your data within 30 days of termination.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Sweden. Any disputes shall be resolved:

First through good-faith negotiation
Then through mediation if negotiation fails
Finally through the courts of Sweden

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

14. Changes to Terms

Epode AB reserves the right to modify these Terms at any time. We will provide at least 30 days notice of material changes by posting the new Terms on this page, updating the "Last updated" date, and notifying you via email. Your continued use of the service after changes take effect constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
